These terms are the agreement between you and Cartel Masks, LLC ("Cartel Masks", "we", "us") when you use cartelmasks.com or buy from it. By placing an order you accept them. If you don't, please don't order.
Cartel Masks products are non-medical cloth face coverings, sold as a fashion accessory.
They are not a medical device. They are not personal protective equipment. They are not a respirator, an N95, a surgical mask, or any other kind of certified protective equipment. They are not FDA-cleared, not NIOSH-approved, and not tested or certified to any filtration or protection standard.
They are not designed, tested, intended, or sold to prevent, treat, cure, diagnose, or reduce the transmission of any disease, illness, virus, bacteria, or infection, and we make no representation, warranty, or claim that they do so. Nothing on this site — including our brand, our slogans, our product names, and any imagery — should be read as a health or safety claim. Our tagline is a joke about masks, not a promise about medicine.
If you need protection from an airborne hazard, a pathogen, dust, fumes, or anything else, you must use equipment that is certified for that hazard, and you should follow the guidance of a qualified professional and of your local health authority. Do not rely on a Cartel Masks product for protection of any kind. Do not use our products in any medical, clinical, industrial, or occupational setting where protective equipment is required.
You are responsible for deciding whether and where a face covering is appropriate for you, and for complying with any rules that apply where you live or work.
Do not put a face covering on a child under 2, on anyone who is unconscious or restrained, or on anyone who cannot remove it without help. Stop wearing it and take it off if you have any difficulty breathing, or if your skin reacts to it. Our masks are 100% polyester — if you have a known sensitivity to synthetic fabrics, they aren't for you.
Every mask is printed to order. Placing an order is an offer to buy; the contract is formed when we accept it and charge your card. We may refuse or cancel any order — including after you've paid — if the item is unavailable, if the listing was priced or described in error, or if we suspect fraud. If we cancel, we refund you in full.
Prices are in US dollars. Postage is charged by destination and shown to you at checkout before you pay. Import duties and customs charges are not included and are yours to pay — see Shipping & Delivery.
Production and delivery times we quote are estimates in good faith, not guarantees. We are not liable for delays caused by our print partners, couriers, customs, weather, or anything else outside our reasonable control.
Made-to-order goods, so no change-of-mind returns. If a mask arrives damaged, misprinted, or wrong, you have 30 days from delivery and we'll replace or refund it. The full policy is in Returns & Refunds, and it forms part of these terms.
Payments are processed by Stripe. We never receive or store your card number. By paying you also accept Stripe's terms. You confirm you're entitled to use the card you pay with.
The artwork, mask designs, brand name, logos, photography, and the text on this site belong to Cartel Masks, LLC and are protected by copyright and trade mark law. Buying a mask buys you the mask. It does not give you any right to reproduce, print, resell, or make derivative works from the designs. Don't copy our artwork.
Don't attempt to break into, disrupt, overload, scrape, or probe this site or its payment systems, and don't use it for anything unlawful. We can withdraw access from anyone who does.
Beyond the returns policy above, and to the fullest extent the law allows, the site and the products are provided "as is", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions don't allow that, in which case the exclusions apply only as far as they're permitted.
To the fullest extent permitted by law, Cartel Masks, LLC and its owners and staff are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, or data, arising out of your use of this site or our products — including any claim arising from the use of a mask as protective equipment, which it is not.
Our total liability for any claim relating to an order is limited to the amount you actually paid for that order. Nothing here excludes liability that cannot lawfully be excluded, such as liability for death or personal injury caused by our negligence, or for fraud.
You agree to indemnify Cartel Masks, LLC against any claim arising from your misuse of a product — in particular, from using one as protective equipment, or in a setting where certified protective equipment is required.
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts sitting in Colorado, and you agree to their jurisdiction.
We may update these terms; the date at the top of this page will change when we do. The terms that apply to your order are the ones published when you placed it.
